Airbnb Law in Turkey

The Ministry of Culture and Tourism proposed new regulations on 25.10.2023, impacting short-term rentals in Turkey. Known as the “New Airbnb Law,” it requires homeowners renting properties via Airbnb to obtain a tourism residence certificate approved by the Ministry of Tourism. These regulations also bring changes to tax rules, emphasizing the need for transparency and accountability in short-term rental activities.

Under this law, short-term rentals are defined as stays of less than 100 days. Properties rented for over 100 days are exempt from the new requirements. For short-term rentals, homeowners must fulfill specific conditions, such as obtaining unanimous approval from title deed holders in buildings or housing estates. For detached houses and villas, owners can apply directly to the Ministry without needing approval from neighbors or other title deed holders.

Additionally, homeowners are required to partner exclusively with companies that hold a Group A tourism certificate from TÜRSAB. Failure to comply with these requirements can result in severe penalties. Homeowners leasing their properties for tourism purposes without the required permits will face fines of TRY 100,000. Intermediary service providers facilitating unregistered rentals will also be fined, starting at TRY 100,000 per dwelling.

To comply with the new rules, lessors must acquire an authorization certificate from the Ministry and display a plaque at the entrance of the property. Approval from all floor owners in residential complexes is mandatory to proceed with rental activities. High-quality housing complexes that meet specific criteria outlined in their management plans may qualify for permits without additional requirements, simplifying the application process for eligible properties.

A transitional period has been introduced, lasting until 1st January 2024, to allow existing short-term rental operators to align with the new regulations. This three-month grace period is crucial for homeowners to complete necessary applications and obtain the required permits to avoid penalties.

These regulations aim to create a more organized and accountable short-term rental market in Turkey. By requiring permits, certificates, and stricter adherence to guidelines, the government seeks to balance tourism development with community welfare. The rules help maintain the quality and safety of rental properties while preventing potential disruptions in residential neighborhoods.

Moreover, the law emphasizes the importance of ensuring short-term rentals meet health, safety, and quality standards. This not only benefits tourists but also protects communities from unauthorized and poorly managed rental activities. Homeowners are encouraged to familiarize themselves with the legal requirements and seek professional assistance if needed to ensure compliance.
